In compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, we inform you that the SCAN AND BUY APP is managed by the commercial company SCAN AND BUY TECH SL, with registered address at Calle Antígona 3, Local 3, Málaga, Spain.
This document establishes the terms and conditions of use of SCAN AND BUY services. Each time you access, browse, or make a purchase through SCAN AND BUY, you are using services offered by SCAN AND BUY TECH SL (collectively, “SCAN AND BUY Services”).
It is necessary that you read these terms and conditions carefully and accept their content before using our services. SCAN AND BUY reserves the right to update or modify these terms and conditions at any time, being effective from the date of their publication.
2. User Account
To use SCAN AND BUY Services, the User must have an Internet connection, a compatible device, and an active and personal user account. The account is non-transferable and must be created by providing truthful and updated data, according to our privacy policy. SCAN AND BUY assumes no responsibility for the use of the account by third parties who have obtained access.
The User must maintain the confidentiality of their account and password, assuming responsibility for all activities that are carried out with their account.
3. Protection of Personal Data
By registering with SCAN AND BUY, the User consents to their personal data being processed in accordance with our privacy policy, for the operation of the app and the personalization of the service. The data may be used for operational and promotional purposes, always in accordance with current data protection regulations.
4. Legal Capacity to Contract
SCAN AND BUY Services are directed exclusively to persons of legal age with the legal capacity to contract. In the event that a User does not meet these requirements, they must refrain from using our services.
5. Purchase Process
To enter the store, the User must log in to the app, scan the QR code on the access doors and/or use facial recognition according to the options that the app offers. The purchase methods include the Scan and Buy and Smart modalities, in which the User scans the selected products or loads them automatically, and makes the payment with the authorized means.
6. Payment Methods and Charges
The User must have a valid payment method associated with their account to carry out transactions. SCAN AND BUY does not store credit card data, and all information is managed and protected by third parties in accordance with security standards. In the event of problems with the payment method, SCAN AND BUY may retry the collection until the amount owed is covered.
7. Purchase Receipts
The receipt for each transaction will be sent to the registered email and will be available in the app for a period of three months.
8. Use of Devices and Compatibility
SCAN AND BUY is designed to function optimally on compatible iOS and Android devices. The company does not guarantee correct operation on devices that do not meet these requirements nor does it offer support for non-updated versions of the app.
9. License of Use
SCAN AND BUY grants the User a limited, non-exclusive, and non-transferable license to access and use its services in a personal and non-commercial manner. Any unauthorized use of the contents, data extraction techniques, or copying is expressly prohibited.
10. Intellectual and Industrial Property
All intellectual and industrial property rights of the content of SCAN AND BUY (texts, images, logos, design, etc.) are the exclusive property of SCAN AND BUY TECH SL or its commercial partners. The reproduction, distribution, or transformation of the content without the express written authorization of the rights holders is prohibited.
11. Risk of Loss
In the case of purchases with home delivery, the risk of loss and ownership of the products pass to the User at the time of delivery to the carrier.
12. Returns, Exchanges, and Refunds
The products acquired may be exchanged, but not returned, except in the specific cases detailed in the “Product Description” section. SCAN AND BUY will not make refunds of price differences when a product of lesser value is chosen in the exchange.
13. Product Descriptions
SCAN AND BUY makes efforts to ensure that the descriptions of the products are as precise as possible. However, it is not guaranteed that the descriptions are always updated or free of errors. If a product does not comply with the description, the User can return it unused, in its original packaging, and in perfect condition.
14. Electronic Communications
By using our services or sending us emails, you are consenting to receive electronic communications from SCAN AND BUY for notifications, agreements, and other communications.
15. Limitation of Liability
SCAN AND BUY services are offered “as is” and “as available”. SCAN AND BUY is not responsible for errors in the description or the availability of products. The maximum liability of SCAN AND BUY in the event of damage or loss will not exceed the amount effectively paid by the User for the product or service in question.
16. Applicable Law and Jurisdiction
These terms and conditions are governed by Spanish law. In the event of a dispute, the parties will submit to the corresponding courts and tribunals.
17. Extrajudicial Resolution of Conflicts
For any complaint or controversy, the User can contact Customer Service through https://scanandbuy.io/, and, where appropriate, resort to methods of extrajudicial resolution of consumer conflicts.
